. republicans and some democrats including chuck hagel at the pentagon who don't like the level of defense spending the way it's squeezed by the budget sequester and it gets squeezed more in 2014 by the sequester proportionately than domestic programs do. that gives some impetus for republicans to go along. democrats are raising the caps by an equal amount on the domestic side of the budget. these are things, priorities the democrats have for social programs, republicans have for defense, which are getting relieved and stitching together solutions to fill in the gaps financially even at a little deficit reduction on top of that, things like raising the fees for airline companies pay for for airport security, that's on the revenue side and on the spending side, curbing federal retirement which some lawmakers don't like but it's a way to get some money. >> jon, thanks for the update. appreciate it very much. john harwood. ty, up to you. >> herbal life may be turning the tables on the hedge fund titan bill ackman. plus, this brings new meaning to the term ski out. how the middle class are get

football and the republicans are like a football team with no offense and only a defense. they just keep trying to stop and never want to advance the ball. they have no strategies but they do have multiple defensive strategies. the repeal movement is now dead. the attack the website movement is slowly going away. but now we have a battle raging on in the courts. new york times notes a fresh wave of legal challenges to the laws playing out in courtrooms as conservatives make the case that mr. obama has overstepped his authority. the opposition never sleeps. >> they don't sleep and it is their organizing principle because i think for grass roots tea party conservatives and don't forget, some of the tea party popped up as obama care was being passed back in 2009 and 2010. there are some people who genuinely see it as the last big reach of government especially on something as personal as health care. there's an emotional sometimes bordering on paranoid fuel that some of the republicans are tapping into with that. and it's the only thing that seems to stir their base. and as far as whatever

the rules of the senate. democrats on defense and republicans believe they can just win red states. get control of the senate. a month ago they erased republican chances of winning the senate. healthcare.gov and things look different. >> the president's approval rating is different. he is at 41, 42% nationally. we know what it will look like in louisiana and arkansas. it's lower than that. it's mid-term elections that are referendum on the president. much more so than individual members. we look at folks like mary landrieu and say these are good candidates and run strong campaigns, but at the same time the drag from the top of the ticket will be a serious issue for them. they have to figure out how to do that balancing act. he is not going to be the last issue they will have to figure out. that for the big picture will be where the president is. he is at 41% into november of 2014. even if you are running a great campaign, it may be too much. >> hagan, landrieu without obama in 08, none of them are in the senate. pryor is a different story. the obama enthusiasm didn't get there in 2008.
